These letters and documents are for an employer to use to follow the correct procedure where an employee is either:
(a) Not performing in their role but an act of misconduct has not occurred; or
(b) Where an employee is absent from work due to illness.
These documents enable the employer to comply with their obligations under the Employment Rights Act 1996 and take into account the Acas Code of Practice on Disciplinary and Grievance Procedures which should be followed when dealing with capability or sickness absence issues, and other best practice advice from Acas.
